Filing of Old/Back Tax Returns with the IRS

Setting reasonable and correct expectations with both the taxpayer and the IRS are essential to successful IRS representation. Looking to the future with a firm schedule in mind is paramount in helping both taxpayers both commit to a plan and to manage expectations. Knowing how long it will take a client to pull information together and then encouraging that all information is assembled as soon as possible is critical in working with the Internal Revenue Service to stop enforced collection efforts such as liens, levies and garnishments of wages. Below is a sample letter you could use to request time needed to address back taxes and to manage expectations for all:

Internal Revenue Service
Atlanta, GA 39901

Dear Sir or Madam,

I am writing you in a good faith attempt to come to terms over the above taxpayers' present predicament and to file all of their unfiled income taxes. Please suspend all collection efforts and the levy on the wages of the above taxpayer so that we might have ample time to get all of the returns completed and filed.

Having a ongoing levy against the taxpayers would preclude the taxpayers ability to address their ongoing financial obligations and indeed impair their ability to live, pay their past taxes and ongoing mortgage, medical costs etc. Accordingly please cease all collection efforts while their offer and allow the taxpayer until 12-31-09 to get all of their income tax returns filed.

The taxpayers had no financial adviser in the past and they have retained me to assist them in this endeavor. At your earliest opportunity please call and confirm that the levy has been stopped and that you have allowed until 12-31-09 to get all of their tax returns completed and filed.
