Re: Appeal of Offer in Compromise
I am writing you in a good faith attempt to come to terms over the above taxpayers' present predicament with the IRS, get their returns filed, and to address their tax issues and to process their Offer in Compromise. I am willing/eager to supply you with any information that you might need in order to process their file.
Enclosed please find:
Your Letter dated 2-20-11
IRS Form 13711/Request for Appeal of Offer in Compromise
I am writing to appeal your initial findings that they do not have a process-able offer and I am appealing that decision. To wit:
1. My name is John C. Dillard CPA of His CPA PC. My phone number is 770 814 9304.
2. I would like to appeal the IRS findings to the Appeals Office.
3. I have enclosed a copy of your 2-20-11 letter.
4. The tax years in question are the taxpayers individual tax returns for the 2008 and 2009 tax years, while noting that their 2010 tax return has been both timely filed and timely paid, indicating their desire, willingness and commitment to remain current on their present filings.
5, 6, & 7. Per your letter we are following your written instructions and wish to Appeal Your Initial Decision Surrounding your Denial of their Offer in Compromise for the following reasons:
The gross wages for the taxpayer for the 2010 tax year was $60,000 which is $5.000 monthly and is further documented by the filing of their personal return (copy enclosed). Please correct the gross income you listed on the Offer Calculation Determination to $5000.
If you were to incorporate the issues attached and the attendant calculation into their Offer Calculation Determination it would be updated as follows. Please note that numbers without any explanation beside them are per your original calculations:
1. I, John Dillard have submitted the protest and accompanying documents.
2. I personally know that the facts stated in the protest and accompanying documents are true and correct.
I look forward to working with you to process the appeal of their Offer in Compromise and I believe that the $15,000 Offer Amount should be processed as per the calculations previously forwarded.
I appreciate your attention to this matter and look forward to working with you to close their file.
